La scadenza \u00e8 fissata per il 17 dicembre.<\/p>\n\n\n\n<p>Vediamo in questo articolo in cosa consiste il Whistleblowing e cosa devono fare le aziende per potersi adeguare a questa nuova procedura che tutela i suoi dipendenti.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cos\u2019\u00e8 il Whistleblowing<\/h2>\n\n\n\n<p>Per Whistleblowing si intende il sistema tramite il quale i dipendenti oppure terze parti (per esempio un fornitore o un cliente) di un\u2019azienda possono&nbsp;<strong>segnalare illeciti<\/strong>, in modo riservato e tutelato, riscontrati durante la propria attivit\u00e0.<\/p>\n\n\n\n<p>L\u2019azienda, a fronte di questa possibilit\u00e0, deve pertanto garantire protezione a coloro che denunciano come previsto dal <strong>decreto legislativo n. 24\/2023<\/strong> che disciplina la protezione delle persone, e nello specifico la figura dei dipendenti, che segnalano appunto situazioni di illegalit\u00e0 di cui siano venute a conoscenza in un contesto lavorativo pubblico o privato.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quali sono le attivit\u00e0 illecite denunciate con il Whistelblowing?<\/h2>\n\n\n\n<p>Vengono considerate illegali tutte quelle attivit\u00e0 che implicano violazioni di leggi o regolamenti, reati e casi di corruzione o frode, oltre a situazioni di pericolo per la salute e la sicurezza pubblica.<\/p>\n\n\n\n<p>Pu\u00f2 capitare che i collaboratori di un\u2019azienda, un fornitore o un cliente si rendano conto che qualcosa non vada, o meglio che alcune pratiche, operazioni o trattative aziendali non vengano svolte correttamente e nella legalit\u00e0.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cosa devono fare le aziende per gestire il Whistleblowing<\/h2>\n\n\n\n<p>La norma, e nello specifico il <strong>decreto legislativo n. 24\/2023,<\/strong> ha previsto il seguente obbligo differenziato per le aziende di diverse dimensioni.<\/p>\n\n\n\n<p>Entro il prossimo 17 dicembre 2023 per le imprese che hanno tra i 50 e i 250 dipendenti e per quelle con meno di 50 dipendenti e che si siano dotate di un <strong>modello 231<\/strong>, scatter\u00e0 l\u2019obbligo di <strong>gestire il whistleblowing<\/strong> nella maniera pi\u00f9 sicura possibile.
